Supplementing our March 5, 2024 Title Tuesday, this week we wanted to update you on pending legislation that will revise Local law 157 of 2016 (“LL-157-16”) which requires the installation of natural gas alarms (the “Detectors”) in all residential dwelling units (includes all private 1 & 2 Family, Class A & Class B Multiple Dwellings), including those properties used for short term residential use (hotel etc.), that are not owner occupied. Other than owner occupied dwelling units, the only other properties exempt from the requirements of LL 157-16 are buildings with no natural gas piping or service. Under the original LL-157-16, owners of all covered properties were to complete the installation of approved Detectors by no later than May 1, 2025. However, due in part to the lack of availability of effective natural gas alarms, the City Council, recently submitted a Bill (Titled: Int 1281-2025) that would postpone the deadline to complete the installation of the Detectors to no earlier than January 1, 2027 (the “Proposed New Effective Date”). The Proposed New Effective Date may be further delayed as the pending Bill requires the NYC Department of Buildings (“DOB”) to submit to the Mayor and the Council, by no later than July 1, 2026, a determination as to whether DOB has been able to identify four (4) distinct manufacturers of battery-powered natural gas alarms; if such determination finds an insufficient number of alarms, DOB would be required to extend the compliance date to January 1, 2029. At present, DOB is not issuing fines or other penalties to property owners who have not yet installed the required Detectors.
