How to Request Your NYC Local Law 97 Filing Extension Before the August 29 Deadline
Supplementing our 10/1/2024 Title Tuesday email regarding the filing requirements mandated under NYC Local Law 97 of 2019 (“LL 97”), which became effective on November 15, 2019, and sets limits on the greenhouse gas emissions starting in 2024 for certain “Covered Buildings”, please note that the New York City Department of Buildings (DOB) has now given property owners an option to extend the filing deadline for LL97 emission reports but only if a formal request for such extension is submitted to DOB before August 29, 2025.
Upon timely filing the extension request with DOB, the new filing deadline will be December 31, 2025 (“the Extended Filing Date”). If Local Law 88 attestations are also needed for the 2025 filing, then the deadline for filing the Local Law 88 attestations would also be moved to the Extended Filing Date along with the LL97 filings.

As a reminder, effective May 1, 2025, Property Owners of Covered Buildings were required to file a report with the DOB detailing their annual greenhouse gas emissions and then by May 1 of every year after so if you have not made the 2025 filing, you may wish to take advantage of this extension option now available for a limited time.
You will recall that Covered Buildings include the following building types:
1. a building that exceeds 25,000 gross square feet
2. two or more buildings on the same tax lot that together exceed 50,000 square feet
3. two or more condominium buildings governed by the same board of managers and that together exceed 50,000 square feet.
The report must be certified by a registered design professional. Buildings that are required to undertake prescriptive measures (e.g. Affordable Housing) will also be required to submit a report of compliance with DOB by May 1, 2025.
